The course deals with the interpretation, critical analysis and practical application of the clauses commonly used in Hull, Cargo and Liability marine insurance contracts by an in depth analysis of the principles of marine insurance law.
The course contents are divided in three parts: at first, it provides an overview of the basic principles of a marine insurance contract, identifies the parties to such contract and its various forms and types, discusses the way that it is concluded and the role of brokers and analyses related fundamental concepts; at a second part, it provides an analysis of the way a marine insurance contract operates and discusses issues related to the classification of the contractual terms, causation and the insured and excluded perils; the final part considers topics related to the measure of indemnity by explaining the nature of losses, distinguishing between total and partial loss and discussing cover in case of actions taken to advert or minimising losses.
The provisions of the Marine Insurance Act 1906 and the Insurance Act 2015, the basic wordings of standard forms of marine insurance clauses used in the London market and examples taken out of case law will be discussed throughout, so as to provide the necessary tools for explaining, interpreting, analysing and evaluating related practical issues.
